Devyani Khobragade Case - No Apology, No Withdraw

US says No Sorry, No Withdraw Case Against  Foreign Secretary India (Consulate General of United States) Devyani Khobragade

Despite India's firm stand over the arrest of Indian diplomat Devyani Khobragade, US on Monday ruled out apology to India on the issue and said that it is not “withdrawing” the alleged visa fraud case.

"The US has no plans to “withdraw” the case against Khobragade and plans to go ahead with her prosecution which is currently gathering evidence before filing the indictment," US sources said.

The sources said that the US has denied any nefarious motive behind Khobragade's arrest and has plans to go ahead with the prosecution as per the law.

However, if Khobragade gets UN immunity, then US will not be able to prosecute her until she enjoys the status but the case will not be dismissed, the sources further said.

Meanwhile, the senior Indian diplomat will still face arrest if she travels to India and then comes back to the US.

Khobragade was arrested on the street while she was dropping her daughter to school and was later released on a USD 250,000 bail. She was later strip-searched in custody and made to stand with common criminals, drug addicts and sex workers by the New York Police, according to media reports.

The arrest of Khobragade created furore with India demanding an apology from the US over the mistreatment meted out to the 39-year-old Deputy Consul General at the Indian Consulate in New York.

While US continues to maintain its stand, India has withdrawn several privileges that were being given to the US diplomats and has asked the American diplomats and consulate staff to submit their ID cards.
